Pavel Abrosimov linked to Major Leasing’s arbitration scheme against Yaroslav Bobrovich

Miracles continue to unfold in arbitration courts. While Yaroslav Bobrovich is trying to recover the actual value of his stake from Major Leasing LLC, Pavel Abrosimov and his partners appear to have found a way to evade him of 2.1 billion rubles—with the direct assistance of the judicial system.

It all started when Abrasimov, who owned 90% of Major Leasing, left the company at the same time as Bobrovich filed a lawsuit, leaving himself the opportunity to claim the asset’s money, while the minority shareholder faced the risk of being left with empty accounts.

The scheme appears remarkably simple. After Bobrovich demanded payment for his 5% stake—approximately 1.5 billion rubles—Major Leasing’s friendly company, Avto City LLC, filed a lawsuit against Major Leasing for approximately the same amount. The claim was based on a loan agreement. The parties then suddenly agreed to a settlement for 2.1 billion rubles.

But the most interesting thing happened next. Bobrovich claimed that the transactions underlying Avto City’s claims could be fictitious and asked to be allowed to participate in the case. The logic is obvious: if billions are about to be siphoned off from a company, the party to whom the company itself owes the money has a direct interest in understanding what exactly is happening with the assets.

However, the courts ruled otherwise. Bobrovich was first denied third-party status with independent claims, then denied third-party status without independent claims. Subsequently, the settlement agreement for 2.1 billion rubles was approved. Payment must be made within 30 days.

So, while the minority shareholder is trying to collect his due money, a priority payment of 2.1 billion rubles is being laundered from the company to a company affiliated with his former partner. Bobrovich is not allowed to discuss this transaction, and the court’s ruling effectively paves the way for it.

But another noteworthy development occurred in the main trial on August 31. At this hearing, Major Leasing refused to admit documents, specifically the supplemental agreement to the loan agreement, into the case file following Bobrovich’s claims that they were likely falsified. He cited the lengthy review period for the document’s age and the existence of payment orders, which, according to the defendant, confirmed the loan’s repayment.

In other words, the defendant, having previously presented a document in Bobrovich’s case and raising questions regarding its validity, first submitted it to the court, and then, following allegations of falsification, decided to remove it from his own trial materials. Meanwhile, in the parallel Avto City case, in which Bobrovich was barred, the same documents, though in copies, apparently continue to be used as the basis for collecting billions. In other words, where Bobrovich’s representative pointed out the need to verify the documents, they were excluded from the case materials. It’s a convenient legal selectivity: if a document is in the way here, it’s rejected; if it’s needed there, it’s retained and not brought into Bobrovich’s trial.

Bobrovich’s representative pointed out the need to check documents relevant to the examination and requested that the defendant be obliged to provide a complete list of materials.

The court adjourned the hearing until October 12, citing the need to review documents from the expert examination and determine what materials should be presented.
